Terms & Conditions

These Terms & Conditions apply to the use of the Grafica Express website and to all quotations, orders, products and services supplied by us.

“Grafica Express”, “we”, “us” and “our” refer to Grafica Express, ABN 89 235 920 841.

“You” and “your” refer to the customer, website visitor or person placing an order.

By using our website, accepting a quotation, approving an artwork proof, making a payment or asking us to begin work, you agree to these Terms & Conditions.

We aim to keep the information on our website accurate and up to date. However, product descriptions, specifications, images, availability, pricing and turnaround times may change without notice.

Product images, photographs and mock-ups are for illustration purposes only. Colours, proportions, materials and finishes may appear differently in the finished product.

Unless clearly stated otherwise, information displayed on our website does not constitute a formal quotation or offer. Final pricing, specifications and production requirements will be confirmed in writing.

Quotations are based on the specifications, quantities, artwork and information provided at the time of quoting.

A quotation may be revised if:

• the specifications, quantities or artwork change;
• additional design, artwork preparation or production work is required;
• supplier, material or freight costs change before the order is confirmed; or
• the information originally provided was incomplete or incorrect.

An order is considered confirmed once we have accepted the order and any required deposit or payment has been received.

Payment terms will be shown on the quotation or invoice. Production may be delayed until payment, suitable artwork and all required approvals have been received.

Unless otherwise stated, all prices are in Australian dollars and exclude GST.

You are responsible for providing accurate artwork, wording, dimensions, quantities, spelling, contact details and other order information.

By supplying artwork, logos, photographs, trademarks or other content, you confirm that you own the content or have permission to reproduce it. You authorise Grafica Express to use the supplied content for the purpose of preparing, manufacturing and supplying your order.

We may refuse to reproduce content that we reasonably believe is unlawful, offensive, misleading or infringes the rights of another person or business.

Additional charges may apply where artwork requires correction, redrawing, colour adjustment, formatting, file preparation or other work before production.

Unless otherwise agreed in writing, editable working files, production files, design concepts and source files created by Grafica Express remain our property. The supply of editable or source files must be agreed upon and quoted separately.

Where an artwork proof or mock-up is supplied, you must carefully check all details before approving it, including:

• spelling and grammar;
• names, phone numbers and contact details;
• dimensions and quantities;
• colours and print positions;
• logos, images and layout; and
• product and finishing specifications.

Your approval confirms that the artwork and specifications are correct and authorises us to begin production.

We are not responsible for errors that were visible in an approved proof, including spelling errors, incorrect information, low-resolution images, incorrect sizes or incorrect quantities supplied or approved by you.

Changes requested after approval may incur additional charges and may affect the production schedule.

Colours displayed on screens and digital proofs are not guaranteed to exactly match printed colours. Screens, printers, inks, fabrics and materials reproduce colours differently.

Where colour accuracy is important, you must provide a Pantone or other recognised colour reference before approving the artwork. We will make reasonable efforts to achieve a close match, but an exact colour match cannot always be guaranteed.

Reasonable variations may occur between production runs, materials, garment batches and printing methods.

Minor variations in colour, size, print position, finishing, cutting or construction that fall within normal printing and manufacturing tolerances are not considered defects.

Where you supply garments, signage, promotional products or other materials for printing, decoration or installation, you are responsible for ensuring they are suitable for the requested process.

We will take reasonable care when handling customer-supplied items. However, some materials may react unexpectedly to heat, pressure, adhesives, inks or other production processes.

Subject to your rights under Australian Consumer Law, we are not responsible for:

• pre-existing faults or damage;
• hidden defects in the supplied product;
• fabric discolouration or dye migration;
• heat press marks;
• coating failure;
• shrinkage or distortion; or
• damage caused by the characteristics of customer-supplied materials.

We may recommend that additional items be supplied to cover possible production spoilage.

Production times are estimates and normally begin only after:

• the order has been confirmed;
• any required payment has been received;
• suitable artwork has been supplied; and
• the final artwork proof has been approved.

Turnaround times do not include weekends, public holidays, courier delays or delays caused by missing information, payment or approvals.

We will make reasonable efforts to meet requested deadlines. However, delivery and completion dates are not guaranteed unless specifically agreed to in writing.

Urgent orders may attract additional charges and remain subject to production capacity, supplier availability and material availability.

You are responsible for providing correct delivery, collection and contact details.

Courier and delivery timeframes are estimates only. We are not responsible for courier delays, incorrect delivery details, missed delivery attempts or events outside our reasonable control.

You must inspect products as soon as reasonably possible after delivery or collection and contact us promptly if there is an issue.

Risk in the products passes to you when the products are delivered, collected or transferred to the courier, subject to any rights that cannot be excluded by law.

Because most of our products are custom-made, changes or cancellations may not be possible after:

• artwork has been approved;
• materials have been ordered;
• production files have been prepared; or
• production has begun.

Where a cancellation is accepted, you will be responsible for any work already completed, design or artwork time, materials ordered, supplier charges and other costs incurred.

We are not required to provide a refund for a change of mind after a custom order has entered production.

This does not affect your rights where a product or service fails to meet a consumer guarantee under Australian Consumer Law.

If you believe a product is defective, damaged or different from the approved specifications, please contact us promptly at:

Please provide:

• your invoice or order number;
• a clear description of the issue;
• clear photographs showing the issue; and
• the quantity affected.

We may request that the products be returned or made available for inspection before providing a remedy.

Where a product or service does not meet an applicable consumer guarantee, you may be entitled to a repair, replacement, reprint, refund or another remedy under Australian Consumer Law.

We are not required to provide a remedy where:

• you have changed your mind;
• the issue was visible in or caused by an approved proof;
• incorrect information or unsuitable artwork was supplied by you;
• products were used, installed, altered, washed or stored incorrectly;
• damage occurred after delivery;
• customer-supplied materials caused the issue; or
• the issue is a reasonable colour, material or production variation rather than a defect.

Products should be carefully inspected before installation, distribution, resale or further processing.

Please do not install, distribute or use products that you believe may be defective before contacting us.

Where installation is included, the customer is responsible for ensuring that the installation location is accessible, safe and ready for the work to be completed.

Additional charges may apply where:

• access is restricted;
• the installation area is not ready;
• existing signage or materials must be removed;
• additional site visits are required;
• parking, permits, inductions or specialised access equipment are required; or
• site conditions differ from the information originally provided.

Unless agreed otherwise in writing, Grafica Express is not responsible for damage caused by unsuitable, unstable, contaminated or previously damaged installation surfaces.

Nothing in these Terms & Conditions excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under Australian Consumer Law.

To the extent permitted by law, Grafica Express is not liable for indirect or consequential loss, loss of profit, loss of opportunity, loss of goodwill or costs resulting from delays, installation, removal, reinstallation, distribution or use of the products.

Where the law permits our liability to be limited, our liability will be limited to one or more of the following:

• repairing the products;
• replacing or reprinting the products;
• supplying the services again; or
• paying the reasonable cost of having the products or services supplied again.

The text, graphics, photographs, layouts, designs, branding and other content on this website are owned by or licensed to Grafica Express.

You may view or print website content for personal use or for the purpose of requesting a quotation or placing an order.

You must not reproduce, distribute, modify, sell, copy or commercially use our website content without our written permission.

Our website may contain links to third-party websites or information about products manufactured, supplied or delivered by third parties.

We are not responsible for the content, availability, security or privacy practices of third-party websites.

Where an order involves an external supplier, manufacturer, installer or courier, their availability and production timeframes may affect the completion of your order.

We collect and use customer information to:

• respond to enquiries;
• prepare quotations;
• process orders;
• arrange delivery;
• manage customer accounts; and
• provide our products and services.

Personal information will be handled in accordance with our Privacy Policy and applicable Australian privacy laws.

Payment card information is processed through the relevant payment provider and is not stored by us unless expressly stated otherwise.

We are not responsible for delays or failure to perform caused by events outside our reasonable control, including:

• supplier shortages;
• equipment failure;
• courier disruption;
• natural disasters;
• industrial action;
• power or internet outages;
• government restrictions; or
• other unforeseen events.

We will make reasonable efforts to notify you and minimise the effect of any delay.

These Terms & Conditions are governed by the laws of New South Wales, Australia.

The parties submit to the jurisdiction of the courts and tribunals of New South Wales and any courts entitled to hear appeals from them.

If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will continue to apply.

We may update these Terms & Conditions from time to time.

The version published on our website at the time an order is confirmed will apply to that order.
